Actor Bill Paxton’s family settlement in Wrongful Death Lawsuit against hospital
Actor Bill Paxton’s family filed a lawsuit against the surgeon and the hospital, and they won the case against them. Bill Paxton, who died in 2017 after heart surgery and a stroke, has settled a wrongful-death lawsuit against Cedars-Sinai Medical Center in California. “The matter has been resolved to the mutual satisfaction of the parties,” plaintiffs’ attorneys Bruce Brolette and Steve Heimberg said in a statement Saturday, the terms of which were confidential. Actor Bill Paxton’s family settlement.
The deal was made a month before the case went to trial, and a judge has yet to sign off on the deal.
The lawsuit alleges the hospital “failed to disclose that [Dr. Khoynezad] was going to use a high-risk and unorthodox surgical procedure with which he lacked experience and was based on information and belief that was beyond the scope of his privilege.”
The hospital and surgeon lawsuit was filed four years ago. The matter was settled shortly before it went to trial. However, attorneys for 30-year-old Paxton’s wife, Louise, and their two children, James and Lydia, filed notices in Los Angeles Superior Court that they had agreed to settle the case.
The family claims that the hospital “failed to disclose that [Dr. Khoynezad] was going to use a high-risk and unorthodox surgical procedure with which he lacked experience and which, on information and belief, was beyond the scope of his privilege.”
